“Upgrade Me Training” does not target and is not intended to attract children under the age of sixteen. All “Upgrade Me Training” courses can only be attended by adults aged 18 or over. Although visitors of all ages may navigate through our websites or use our app, we do not knowingly collect or request personal information from those under the age of sixteen without parental consent. If, following a notification from a parent, guardian or discovery by other means, a child under sixteen has been improperly registered on our site by using false information, we will cancel the child’s account/booking and delete the child’s personal information from our records.

We collect: name, email address, phone number, gender, delivery/shipping address, course details of your selection.

Why we collect Functional Data: We collect this information to book you on the training course of your selection, provide you with pre- and post- course customer service, notify you when there are updates on your course (example change of course location, cancellation of a course, publication of your course results etc). We also collect this information to guide product improvement and customer support decisions which is our legitimate interest.

Getting Help from “Upgrade Me Training”

From time to time, you may decide to contact our Customer Support group for assistance with your “Upgrade Me Training” Products/Services. To be able to offer you the best service possible, we may collect certain data from you or your “Upgrade Me Training” Products.

Welcome to “Upgrade Me Training”. By using “Upgrade Me Training” (including upgrademeuk.com and its related sites, services, and tools), you agree to the following terms with “Upgrade Me Training”. If you have any questions, please refer to our help section. This Agreement is effective on 9th September 2019, for current users, and upon acceptance for new users.

Definition:

The following definitions have the same meaning whether they are singular or plural.

’Student’ means a customer who reserves and/or books one or more Services offered on the Website.

‘Events’ means the offering of bookings to training events.

‘“Upgrade Me Training”’ means “Upgrade Me Training LTD”

‘General Terms and Conditions’ means these general terms and conditions for booking and use, as amended from time to time.

‘Rules and Restrictions’ means the terms and conditions applicable to the Suppliers (Training Providers) with whom the Customer has concluded the contract at the time of booking the course.

‘Service’ means a service offered on the Website, such as the booking of training services and assessment services with approved training providers.

‘Supplier’ means a supplier of Services, such as a trainer, tutor or also applies to third party training provider/centre.

‘Website’ means the www.upgrademetraining.com and related websites.

Before you may become a member of “Upgrade Me Training”, you must read and accept all of the terms in, and linked to, this User Agreement and the “Upgrade Me Training” Privacy Policy. We strongly recommend that, as you read this User Agreement, you also access and read the linked information. By accepting this User Agreement, you agree that this User Agreement and Privacy Policy will apply whenever you use “Upgrade Me Training” sites or services, or when you use the tools, we make available to interact with “Upgrade Me Training” sites and services.

These General Terms of Service apply to offering and providing of the Services by “Upgrade Me Training” operates the Website which acts as an interface between the Customer and “Upgrade Me Training” or Products/courses booked via “Upgrade Me Training”. That are carried out by third party training providers.

These General Terms and Conditions are subject to the Suppliers’ Rules and Restrictions which are made available to the Customer and which the Customer also accepts now that a booking is actually placed. It is the Customer’s responsibility to familiarise himself/herself with the Suppliers’ Rules and Restrictions.

The General Terms and Conditions can be changed by “Upgrade Me Training” at any time without prior notice, although such changes will not apply to bookings that have already been accepted by “Upgrade Me Training” on behalf of the Supplier(s) concerned. It is therefore essential that the Customer reads, saves and/or prints a copy of the General Terms and Conditions at the time the booking is placed, in order to be aware of the provisions in force.

The Website helps the Customer to find training products and to make the necessary reservations and acts as an interface in the transactions involved with the Suppliers. The Customer must be at least 18 years old, be legally authorised to enter contractual obligations, have the requisite consent or authority to act for or on behalf of any persons included in a booking and must use the Website in accordance with these General Terms and Conditions and the Website Terms of Use.

The Customer is responsible for his / her activities on the Website (financially or otherwise), including the possible use of his / her username and password. The Customer guarantees that the information entered by him / her on the Website in relation to him / her is accurate.

Any use of the Website that is fraudulent or conflicts with these General Terms and Conditions shall be reason for refusing the Customer access to the Services offered by “Upgrade Me Training “and the Suppliers or to the other functionalities of the Website.

In these Terms, “we” means “Upgrade Me Training” and “you” means the person or business that purchases delegate places on classroom courses at the training providers premises and/or private courses on your premises, as set out in the invoice. If your course is provided by a third party and not “Upgrade Me Training” We will be acting as purely a booking agent just processing the payment for a fee from the learning provider who you are booked in with. In this scenario We take no responsibility for the standards of training supplied by its recommended training providers who are approved by UK Awarding Organisations. Any issues regarding the standard of training should be forwarded to the relevant training provider not to “Upgrade Me Training” who are in these circumstances acting as the referral organisation not the training supplier. Your training provider’s details are available on the website and will be provided to you upon booking of your course via email and SMS message.

While using “Upgrade Me Training” sites, services and tools, you will not:

  • post content or classes in an inappropriate category or areas on our sites and services.
  • violate any laws, third party rights or our policies.
  • use our sites, services or tools if you are not able to form legally binding contracts, are under the age of 18, or are temporarily or indefinitely suspended from using our sites, services or tools.
  • fail to deliver payment for a class purchased by you, unless the provider has changed the class’s description after you purchased, a clear typographical error is made, or you cannot authenticate the providers identity.
  • fail to deliver a class purchased from you, unless the student fails to meet the posted terms, or you cannot authenticate the student’s identity.
  • manipulate the price of any class or interfere with other users’ listings.
  • circumvent or manipulate our fee structure, the billing process, or fees owed to “Upgrade Me Training”.
  • post false, inaccurate, misleading, defamatory, or libellous content (including personal information);
  • take any action that may undermine the feedback or ratings systems (such as displaying, importing, or exporting feedback information off of the sites or using it for purposes unrelated to “Upgrade Me Training”).
  • transfer your “Upgrade Me Training” account (including feedback) and User ID to another party without our consent.
  • distribute or post spam, unsolicited, or bulk electronic communications, chain letters, or pyramid schemes.
  • distribute viruses or any other technologies that may harm “Upgrade Me Training”, or the interests or property of “Upgrade Me Training” users.
  • export or re-export any “Upgrade Me Training” tools except in compliance with the export control laws of any relevant jurisdictions.
  • copy, modify or distribute rights or content from the “Upgrade Me Training” sites, service or tools or “Upgrade Me Training’s copyrights and trademarks; or harvest or otherwise collect information about users, including email addresses, without their consent.

Abusing “Upgrade Me Training”

“Upgrade Me Training” and our users work together to keep our sites and services working properly and safely. Please report problems, offensive content, and policy violations to us. Without limiting other remedies, we may limit, suspend or terminate our service and user accounts, prohibit access to our sites and their content, services and tools, delay or remove hosted content, and take technical and legal steps to keep users off the sites if we think that they are creating problems or possible legal liabilities, infringing the intellectual property rights of third parties, or acting inconsistently with the letter or spirit of our policies (for example, and without limitation, conducting off-”Upgrade Me Training” transactions, feedback manipulation, circumventing temporary or permanent suspensions or users who we believe are harassing our employees or other users). Additionally, we may, in appropriate circumstances and at our discretion, suspend or terminate accounts of users who may be repeat infringers of intellectual property rights of third parties. We also reserve the right to cancel unconfirmed accounts or accounts that have been inactive for a long time, or to modify or discontinue “Upgrade Me Training” sites, services or tools.

If you use this site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. You may not assign or otherwise transfer your account to any other person or entity. You acknowledge that “Upgrade Me Training” is not responsible for third party access to your account that results from theft or misappropriation of your account. “Upgrade Me Training” and its associates reserve the right to refuse or cancel service, terminate accounts, or remove or edit content in our sole discretion.

“Upgrade Me Training” does not knowingly collect, either online or offline, personal information from persons under the age of thirteen. If you are under 18, you may use https://www.upgrademeuk.com only with permission of a parent or guardian.

In order to secure your course, you must pay “Upgrade Me Training” or the training provider appropriate costs in full, or subject to agreement, in part, with the remainder due before the course start date.

Customers may apply for a place on the course with “Upgrade Me Training” or Third-party training providers via the website interface and pay premium price on the day of training course to the training provider. However, a reservation without payment is not a confirmation of enrolment. Customers will be allowed to join the training depending on the size of the classroom available, if the class room is full, customers may be asked to attend the following course.

Where a training course is offered at a discount from our list price, the discounted price offered is subject to payment with booking and availability of places.

Payment can be made by Visa, MasterCard, or bank transfer. Bank details are available upon request.

“Upgrade Me Training” reserves the right to change prices without notice.

It is a requirement for the student to communicate effectively in English, to comply with this the trainer will assess your level of your English before the start of the course, if this requirement is not met you will not be allowed to attend the course.

If you need to cancel or amend the course booking
  • If you need to cancel or amend a confirmed booking, cancellation/amendment charges may incur.
Rescheduling your course
  • If you are unable to attend on the scheduled course date reserved, you must notify “Upgrade Me Training” and/or the Training Provider prior to the course start date. If you do, we will agree to reschedule the course date with you for any course date within the next 6 months, at the same location, subject to availability. There will be a fee of £90 for this.
  • A reschedule request must be sent to us either via telephone or email 48 hours before the start of the course. We only allow a maximum of 2 reschedules per booking. You will be required to complete a new booking if you do not attend the course within 6 months of the initial course start date.
Insufficient ID brought to the course and lateness.
  • It is a legal requirement to have ID on you at all times during your training. If you do not bring the required IDs to your course, you will need to be rescheduled onto another course and you will be charged a £90 rescheduling fee.
  • If you are going to be late to the course, you must contact “Upgrade Me Training” and/or your training provider immediately. If you a going to be substantially late to the course, you will have to be rescheduled onto another course. You will be charged a £90 rescheduling fee for this.
Cancelling your course
  • If you need to cancel your course, you will not receive a refund.
  • If you have paid a deposit and fail to notify of non-attendance, you are not eligible for a reschedule. The you will not receive a reimbursement of your deposit and the remaining payment will be due.
  • In the event of non-attendance where payment has been received, you will not be eligible for a refund.
  • If you have to cancel your course due to a medical reason, we will require evidence i.e., Doctor’s letter. A handling and administration fee of £60 would be charged or deducted from your order amount when you require a refund due to a medical reason.
Cancellations to courses by the Training Provider
  • If a Training Provider cancels a course, you are eligible for a full refund for the cancelled course. If your training provider conducts a literacy test and you are unable to pass it, you will be given a refund. A handling and administration fee of £60 will be deducted from your order amount.
Discounted courses
  • We operate a no refund and no cancellation policy for discounted courses.
Corporate/In-house courses
  • Courses arranged specifically to train staff members or candidates from the same organisation fall in this category. Full Payment must be received 5 working days before course start.
  • All corporate/in-house bookings are non-refundable in the event of a cancellation by the customer or failure to pay the total due amount in full.

“Upgrade Me Training” complies with the law and operates the following refund policy in respect of the cancellation of individual course bookings.

If a course is run exclusively for a Corporate Customer – at a training provider’s premises, on a customer site or any other alternative venue – the same refund terms apply in the event of cancellation, but an alternative course date can be arranged by agreement.

Refund request for Online Courses

We are committed to providing high-quality education and ensuring that our students are satisfied with their learning experience. If for any reason you are not satisfied with your online course, you may request a refund within 30 days of your enrollment date. To initiate the refund process, please contact our customer support team. Refunds will be issued to the original payment method used at the time of enrollment.

Please note that this satisfaction guarantee and refund policy applies only to online courses. In-house courses are subject to different terms and conditions.

 

In the unlikely event it becomes necessary to change your course, in total or in part, we will inform you as soon as is reasonably possible of any necessary changes. You shall have the choice of:

Accepting the changed arrangements;
Or purchasing another course from us (and paying or receiving a refund in respect of any differences);
Or cancelling your course and receiving a full refund of all payments made.

Assessments are marked by the training provider’s (wether it be “Upgrade Me Training” or a third-party Training Provider) awarding organisation, and results are made available in 14 working days of sitting the exam, there may be a further delay in exam results by the awarding body. The results are provided by the training provider and can also be checked online.

“Upgrade Me Training” will not be liable for any kind of loss in case of a delay in result by the training provider or their nominated awarding organisation.
